I. Basic Provisions

1. Blue Mind s.r.o., Company ID 07509090, with its registered office at Průběžná 1826/23, 100 00 Praha 10 – Strašnice, is the controller of personal data pursuant to Article 4 (7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons in connection with the processing of personal data and on the free movement of such data (hereinafter: “GDPR”). (hereinafter: “the Controller”).

3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be directly or indirectly identified, in particular by reference to a certain identifier, for example a name, identification number, location data, network identifier or to one or more special elements of physical, physiological, genetic, psychological, economic, cultural or social identity of this natural person.
4. The Controller has not appointed a data protection officer.

II. Lawfulness of Personal Data Processing

1. Lawful reasons for data processing include:
• performance of a contract between you and the Controller pursuant to Article 6 (1) (b) of GDPR (hereinafter “Contract Performance”);
• the Controller’s legitimate interest in direct marketing (especially sending commercial messages and newsletters) pursuant to Article 6 (1) (f) of GDPR;
• your consent to processing for the purposes of direct marketing (in particular, sending business communications and newsletters) pursuant to Article 6 (1) (a) GDPR, concurrently with Section 7 (2) of Act No. 480/2004 Sb., regulating certain information society services, in the event that no goods or services have been ordered (hereinafter: “Consent”.
2. The Controller does not perform automated individual decision-making in the sense of Article 22 of GDPR.

1. Unless otherwise stated above, the Controller retains personal data:
• for a period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller, and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship);
• until the consent to the processing of personal data for marketing purposes is withdrawn, if personal data is processed on the basis of consent.
2. After the personal data retention period has expired, the Controller deletes the personal data.

1. If cookie files are listed among personal data under Article III, the following rules apply to the processing thereof:

VI. Recipients of Personal Data (the Controller’s Subcontractors)

1. The Controller intends / does not intend to transfer personal data to a third country (a country outside the EU) or an international organisation. Recipients of personal data in third countries are the providers of mailing services and of the booking system.

1. Under the conditions set out in GDPR, you have:
• the right to access your personal data pursuant to Article 15 of GDPR;
• the right to have your personal data rectified pursuant to Article 16 of GDPR, or to restrict processing according to Article 18 of GDPR;
• the right to have your personal data erased pursuant to Article 17 of GDP;
• the right to object to processing according to Article 21 of GDPR;
• the right to data portability pursuant to Article 20 of GDPR;
• the right to withdraw your consent to processing in writing or electronically to the Controller’s postal or e-mail address mentioned in Article III of these terms.
2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VIII. Security of Personal Data

1. The Controller declares that it has adopted all appropriate technical and organisational measures to secure personal data.

1. By submitting a purchase order via the on-line order form, you confirm that you have familiarised yourself with the terms of personal data protection and that you accept them in their entirety.
